One of the more common questions that I get asked by my clients is: what is the difference between driving under the influence and driving whilst impaired? The answer is very little. However, both are serious offenses and can cause irreversible issues if not dealt with properly.
In Michigan, the penalty for driving under the influence includes a hefty fine and jail time, and that can be for a first-time offense. I’ve spent my adult life dedicated to practicing law and providing my expertise in criminal defense to people who need my help.
In the broader sense of the meaning, ‘impaired driving’ can encompass operating a vehicle whilst being impaired due to alcohol, drugs (prescription and illegal), sleepiness or a medical condition. Usually, the phrase ‘driving under the influence’ (DUI) refers to alcohol and recreational drugs.
If you get served with a DUI, then the first thing to do is not panic. Being arrested for driving under the influence in Michigan probably won’t be a proud moment, but is nothing to be ashamed of, especially if it is the first time you’ve been charged.
I believe a DUI is a truly humbling experience and something that can definitely be learned from, and that for the majority of people, being arrested is something that happens once in their lifetime. Therefore I truly think that such an infraction should not ruin your future career prospects or social standing.
